In these Terms and Conditions, the following expressions carry the meanings set out below:

• "The Practice" / "We" / "Us" / "Our" refers to Ramkhamhaeng Law, a legal practice registered and operating in Thailand, with offices at 1247 Ramkhamhaeng Road, Hua Mak, Bang Kapi, Bangkok 10240.
• "Client" / "You" / "Your" refers to any individual who instructs the Practice or accesses this website.
• "Services" refers to the pension legal services described on this website, including Pension Claim Documentation Preparation, Pension Determination Review, and Pension Litigation Counsel.
• "Engagement Letter" refers to any written confirmation of instructions issued by the Practice to a client.
• "Agreement" refers collectively to these Terms and Conditions together with any Engagement Letter issued for a specific matter.
• "Website" refers to the site accessible at ramkhamq.info and its subpages.

By accessing this website or instructing the Practice to act on your behalf, you confirm that you have read, understood, and accepted these Terms and Conditions in their entirety.

Our services are intended for individuals who are at least 18 years of age and who have the legal capacity to enter a binding agreement under Thai law. If you are acting on behalf of another person, you confirm that you have authority to bind that person to these Terms.

If you do not agree with any part of these Terms, you should refrain from using this website or engaging our services.

Ramkhamhaeng Law provides legal services to individuals in Thailand in connection with pension rights and pension defence matters. Our principal services are:

• Pension Claim Documentation Preparation — assistance with the preparation and assembly of documentation required to submit a pension claim to the relevant authority.
• Pension Determination Review — legal review of a pension determination received from an administering authority, together with a written opinion on available avenues for response.
• Pension Litigation Counsel — representation in court proceedings relating to pension matters, including case preparation, pleadings, and court attendance.

The scope of any engagement is confirmed in writing by way of an Engagement Letter issued prior to commencement of work. Services are available to clients located in Thailand. The Practice does not offer services to persons resident outside Thailand without prior written agreement.

An engagement commences only when an Engagement Letter has been issued by the Practice and accepted by the client. The Engagement Letter will specify the nature of the work, the fee, and any specific instructions or limitations agreed between the parties.

Where the scope of a matter changes materially after commencement, the Practice will discuss the revised scope with the client and issue an amended Engagement Letter where appropriate. Additional work falling outside the agreed scope will be subject to separate agreement on fees before it is undertaken.

In connection with any engagement, the client undertakes to:

• Provide accurate, complete, and timely information as reasonably requested by the Practice in connection with the matter.
• Disclose all facts that may be material to the conduct of the matter, including information that may be unfavourable to the client's position.
• Respond to communications from the Practice within a reasonable time, and in any event within any deadline communicated.
• Not instruct any other legal adviser in respect of the same matter without informing the Practice.
• Use this website lawfully and in accordance with these Terms, and refrain from any conduct that could harm the Practice's systems or reputation.

The Practice will not be responsible for any adverse outcome that results from a client's failure to provide accurate information or to respond in a timely manner.

Fees are denominated in Thai Baht (฿) and are as set out in the Engagement Letter for the specific matter. The indicative fees displayed on this website represent the standard charge for the scope of work described and may be subject to adjustment if the matter is more complex than anticipated.

Fees are payable prior to commencement of work unless otherwise agreed in writing. For litigation matters, fee arrangements will be discussed openly with the client before proceedings are issued.

Payment may be made by bank transfer to the Practice's designated account. Details will be provided in the Engagement Letter.

Regarding refunds: where work has been commenced, a proportionate fee for work done to the date of termination will be payable. Fees for work not yet commenced will ordinarily be returned. The Practice will discuss any fee adjustment with the client fairly and in good faith.

All content published on this website — including text, layout, design elements, and documentation templates — is the intellectual property of Ramkhamhaeng Law or its licensors. Nothing on this website should be construed as granting any licence or right to reproduce, distribute, or adapt such content without prior written consent.

Documents, opinions, and written advice produced by the Practice for a client in the course of an engagement are provided for the client's personal use in connection with that matter only. They may not be reproduced, shared with third parties, or relied upon for any purpose other than that for which they were prepared without the Practice's prior written consent.

The Practice treats all client information as confidential. Information shared by a client in connection with a matter will not be disclosed to any third party without the client's consent, except where disclosure is required by law, court order, or applicable professional rules.

Clients are asked to treat as confidential any advice, strategy, or opinion provided by the Practice, and to refrain from sharing such material in any way that could prejudice the conduct of the matter.

To the fullest extent permitted by Thai law, the Practice's liability to any client in connection with a specific engagement is limited to the fee paid by that client for the relevant service.

The Practice will not be liable for any indirect, consequential, or incidental loss, including loss of income, loss of business, or loss arising from delay, unless such loss results from the Practice's gross negligence or wilful misconduct.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including liability for personal injury caused by negligence or for fraudulent misrepresentation.

You agree to indemnify and hold harmless the Practice, its partners, and staff from any claim, demand, loss, or expense (including reasonable legal costs) arising from: (a) your breach of these Terms; (b) your provision of inaccurate or misleading information in connection with a matter; or (c) your unlawful use of this website.

Either party may terminate an engagement on reasonable written notice to the other. The Practice may terminate immediately if the client has provided false or misleading information, failed to comply with reasonable instructions, or behaved in a manner that makes it impractical to continue the engagement.

On termination, the client will be responsible for fees in respect of work done to the date of termination. The Practice will use reasonable efforts to return the client's documents within a reasonable time, subject to any lien for unpaid fees.

Provisions of these Terms that by their nature survive termination — including those relating to confidentiality, intellectual property, liability, and dispute resolution — will continue in effect following any termination.

These Terms and any engagement entered into under them are governed by the laws of the Kingdom of Thailand. Any dispute arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Thailand.

Before commencing formal proceedings, the parties agree to attempt to resolve any dispute through direct discussion in good faith. If a matter cannot be resolved informally within 30 days of written notice, either party may refer the matter to the courts.

• Entire Agreement. These Terms, together with any Engagement Letter, constitute the entire agreement between the parties in respect of the subject matter and supersede any prior communications or understandings.
• Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
• Waiver. A failure or delay by either party in exercising any right under these Terms will not constitute a waiver of that right.
• Assignment. Clients may not assign their rights or obligations under these Terms without the Practice's prior written consent. The Practice may assign its rights in connection with any reorganisation of the practice.
• Notices. Notices under these Terms should be delivered by email to the address specified in the Engagement Letter, or in writing to 1247 Ramkhamhaeng Road, Hua Mak, Bang Kapi, Bangkok 10240.

The Practice may update these Terms from time to time. Revised Terms will be published on this website with an updated date. For existing engagements, changes will not apply retroactively without the client's agreement. Continued use of this website following publication of revised Terms constitutes acceptance of those Terms.
